It's not a matter of whether this kid was too much of an idiot to care about, it's a matter of exactly how prosecution-happy parts of the US are. It's one thing for a dumbass to say dumbass things online, it's another for dumbasses to be running the courts so that you can make a clear and present danger out of anything.

Suppose the kid were black, how would you be interpreting the case? Suppose he were a Muslim?

I get that you're expressing disdain for this guy and his ilk, but your position is absolutely indefensible.

He hasn't even been to trial yet. They set his bail at 0,000. This is an old video and more recent reports are saying he's been moved for his own protection multiple times and has gotten the shit kicked out of him.

Even if you still wanna turn a blind eye to this kid's suffering because you don't think you would like him, his trial's costing the state money, his incarceration is costing money, and hopefully when he gets out his lawsuit will cost the state money.

He was talking about an imaginary school with imaginary children. You're talking about putting an innocent person through serious prison time. The weird part is it used to be the other way around. DotA 2 and HoN were home to the old diehard DotA players who were the typical massive assholes you'd expect from the kind of people still giving a shit about a 7+ year old video game (think Counter Strike players). LoL was the game where all the casual players went. Sure it was still toxic, but it was a grand canyon difference between the two. HoN/DotA 2 would start screeching at you right at character selection while LoL players would at least wait for the game to start before you were a faggot.

Then something weird happened. For some reason it completely swapped. LoL is now screecher territory while DotA 2 is pretty chill.

I think it happened around the time the makers really started pushing LoL as an "e-sport". Everyone started watching tournament streams and suddenly everyone was an expert who screeched if you didn't follow the "current meta". In an unranked game at the bottom 10% of players? Doesn't matter, the screechers will still be on you.

It's like going to a local pickup basketball game where everyone is "that guy" who rags on anyone not wearing 0 Air Jordans.

Having played a fair amount of LoL, I think the "worst pickup basketball game ever" analogy is pretty appropriate. If every game, there was one guy who considered himself the next LeBron James even though he can't make the junior varsity squad, who rages at his teammates every time they do anything other than throw him the ball, and who eventually gets to the point where he starts shooting the ball in the other basket and blocking his own players' shots out of spite.

And, for some reason, this guy is never on the OTHER team.

Responding to a threat of violence is not a violation of the First Amendment. Blowing this incident so completely out of proportion is an injustice, yes, but the First Amendment doesn't guarantee the right to threaten grave bodily harm to others without consequences.

Like I say, they blew this incident completely out of proportion.

Here's the deal: the First Amendment is between you and the government. The government can't censor you just because the government doesn't like what you're saying; that's the First Amendment. But when it comes to citizen vs. citizen, that is another matter altogether, and the First Amendment doesn't protect every single thing you do. So if you have expressed a threat to other people, and it's a credible threat, expect consequences.

In this case, the only issue is how far from credible the threat is. If he were deadly serious and the cops actually saved lives, you wouldn't be First Amendmenting, you'd call it good police work.

We're obviously just going to ping pong off of each other on this, in classic Internet limp-wristed hissy fit slappery style until POETV finally closes down. Context is king here and your scenario calls for a lot of alterations to that context. At least now he is a genuine threat to society, what with breaking him in a socially acceptable way (leave him to be preyed on by inmates, toss him in solitary confinement, etc.).

Context isn't the issue. Threatening others with bodily harm is not protected under the First Amendment, and the only question here is whether the threat is at all credible (we agree that it is not).

Not that I think it's cool to be a jackass on the interwebs, but for fucks sake, this kid is guilty of not being clever enough to tell a joke, not legitimately threatening people's lives. In a random debate, I was once asked if there should be legal ramifications if people made racial remarks, or published hate speech, and at the time I said that there should be, in order to teach people that it's not okay. Even though this is a stretch from that, I can see the point in the other side of the argument now; if we want to stop bullying or threatening, what happened with Paula Deen needs to repeat itself. Something like this is just uncalled for.
