The question is about Common Law, and Common Law is notoriously West Virginian in its sensibilities. Here's what Wikipedia says about Common Law and age of consent:

"The English common law had traditionally set the age of consent within the range of 10 to 12, but in 1875 the age was raised to 13. After intense sensational media revelations about the scourge of under-age prostitution in London in the 1880s caused respectable middle-class outrage, the age of consent was raised to 16 in 1885."

So this guy wasn't that far off -- and since Common Law varies, it quite possibly sets the age of consent to 12 or 14 in some places. And there's nothing about this guy's answer that suggests he thinks the age of consent should be that low, only that he's supposing Common Law says so.

One other thing: if puberty signals adulthood, does it not also signal the ability to consent? How could it not?

This video has been making the rounds, and all I see is a guy taking a stab at answering a question about a very backward legal code, but everyone's eager to brand him a perv. I bet it's making his life needlessly shitty.

IF puberty signals adulthood. That was the premise of the Jeopardy question, after all.

Personally, I don't think it does. I think there is this whole "adolescence" concept where you are not an adult even though you can reproduce. That's a pretty standard concept in modern Western society ... but apparently Common Law does not see it that way.

If it wasn't for "in common law", I'd assume the question is "puberty." But puberty has nothing to do with anything legal, does it? Like, you can't be denied going to high school or getting a drivers' permit when you're 14 or 15 if you haven't gone through puberty yet, right?

Age of consent and responsibility varies greatly in different cultures. Most of this EU has a more "West Virginian" gap than West Virginia itself, which has an age of consent of 16 years. Not only that, if you are under the age of consent in WV and you have sex with somebody over the age of consent, you are guilty of a crime. The subclause is the "Romeo & Juliet" laws, where two minors of similar age can avoid prosecution, but a 17 year old having sex with a 14 year old might be a criminal offense. It's weird how different that is to a barbaric society like France or the Netherlands.

Compare to Malta, where the age of responsibility is a mere 9 years old.

The "frothing" part probably has more to do with the leap from "Common Law says" to "I think that". You can't make that leap with reason alone.

Yeah, the "Common Law" part had me confused as to the relation to puberty. I could see the answer being minimum age of criminal culpability (i.e. the age where they can at least charge you as a juvenile) because it floats around that age in most places. Answering fast on Jeopardy is all about connecting two dots in the answer to get a question asap; I think the dude just picked the answer based on those dots and got a really bad result.

badideasinaction is right. The trick to Jeopardy is that all the questions have little clues in their wording to help you figure them out. The producers know it, and sometimes try to throw off contestants. This question was designed to get some dope to pull the trigger early and say "age of consent."

Possibly to get a perv to out himself.

Yeah me too. I always have it on when I'm at work, but I must've been busy and missed this one. At least he'll be famous for a little while.. I was really hoping the guy last night would've won, having bet all of his money save for a buck on a really easy Shakespeare clue. Seriously, even if you slept through high school English, I'm pretty sure everybody knows that. Anyway I don't know if I've ever seen someone win on Jeopardy with just a buck, which was probably his angle.
