Even though I never met the guy, I admired my ex-wife's public defender after her DUII; luckily it was around bartime and nobody was on the streets but she hit about 6 cars in a very narrow (and confusing) intersection and continued to drive home. While I was the comforting "it could happen to anyone" husband, dude was a total hardass to a tiny, sobbing girl who had a little too much to drink one night. He DID get her out of jail time in lieu of community service and meetings, reminding her that even a sip of Kombucha would show up in her system and she'd go directly to jail.

Now, if it was vehicular homicide and it's obvious the driver is drunk, that's a different story, but I don't think that's really in the jurisdiction of these guys. The bad ones will try to get you off the hook, but the good ones will do so by making damn sure that you never think about doing it again.

Whoops our comments overlapped. Yeah, there's bullshit reasons: I got a DUI on my bike a few years ago. I was leaving the bar, having had 3 beers (that's nothing for me) and a 5 block ride home. My chain locked up in the middle of the street and I took a spill right in front of two cop cars that just happened to be there. The more I argued that I could WALK my bike home and they could follow me, the more angry they got, breathalyzed me and threw me in the drunk tank overnight, not even telling me what I breathed (it had to be under the legal limit, or at least I wasn't drunk..)

So yeah, that was just the cops meeting their quota. Another time some friends of mine were driving to visit family in South Dakota and from what I understand having an Oregon license plate is pretty much your undoing. They got pulled over and they didn't have any drugs or alcohol on them, but after a thorough search found a single oxy pill between the seat cushions. 10,000 bail, just like that.

The whole "DUIs aren't a big deal if you don't hurt anyone" are the whole reason people take the chance driving drunk anyhow. And it's in a fucking two ton plus weapon. Your ex could have just as easily smeared some guy against one of those cars if the odds put someone there.

@Solro that's why I said "luckily." Fact of the matter was, I was pissed, probably more pissed than her Lawyer, and not just because she totaled my car, and made us both a menace in our neighborhood where everybody knows each other. But, because, yeah, she was a pussy hair's chance away from taking a life at any given moment.

In my case, I'll admit that I was the pussy: we were leaving the bar, less than 30 blocks from home, and I told her that we were both too drunk to drive, that she should hand me the keys, and she told me to go fuck myself so I was like "fine. Drive then." That was a dumb thing to do, almost as if I was daring her NOT to get into an accident (we were also going through a divorce at this time so my mind wasn't entirely in the right space).

But police, like in my bike example, do take this and make it their leverage. Another time I was walking home from a bar and the adjacent motorcycle bar was leaving on their crotch rockets going well over 100 MPH and ignoring stop lights. A few seconds later I saw a large amount of smoke.. I went down and there was one of the cyclists with their brains splattered all over the concrete. The reason for this? A girl and her boyfriend had had a drink or two, obviously sober, and were pulling left into a McDonalds when one of the cyclists hit them. What I saw were a ton of drunk motorcyclists riding away from the bar, and witnesses saw was a girl with the right of way. But, she simply mentioned that she was AT the bar, and tested positive for something far under the legal limit and was charged with vehicular manslaughter. That's not fucking fair.

most of the exceptional cases you're trying to paint as 100% of DUI arrests (poor people, poor black people, etc) cant afford a DUI lawyer to get them off. So you're literally defending a two tier justice system.

The solution to a 2-tier justice system, or a drunk-driving manslaughter epidemic is not "fuck due process".
Due process at least gives people a chance to counter other abuses.
