The audience most likely isn't paid. They're probably just like any other TV studio audience.

It is true that you don't pay if you lose a suit. However, there's one big pool of money. If you win the case, you get paid from that pool. The remainder is then divided evenly between the two parties. So basically, they fight for a bigger slice of the pie.

Also: Can someone with a better understanding of the law explain whether she actually broke the law or not? Does stating "this auction is for a photo only" in small print protect the dickhead from legal action if the rest of the add indicates you are bidding on an actual item?

She sold something under false pretenses and then refused to provide a refund. This is what is commonly known as fraud, and is a crime in any civilized society.

As a lawyer, I agree with the idea that this is extremely unprofessional conduct for a judge, and anyone behaving like this ought to be reported to the Bar. Especially in a bench trial like this, where there isn't a jury to be prejudiced by the comments of the judge, moral judgments by the judge aren't necessarily an unfair thing, but snide comments about how a party to the case is a fat baby factory is right the fuck out. It diminishes the prestige of the office, and the Bar isn't going to endorse that kind of nonsense.

That said, Judge Judy isn't a judge. She's a mediator. This isn't a trial; it's Alternative Dispute Resolution.

Judge Judy is a guilty (*LOL*) pleasure of mine, and as a person that enjoys pleasure, I think she should continue being who she is and entertaining me when I'm on the couch.

I've had to sit through some small claims stuff in real life and it would appear judges give themselves quite a bit of town alderman flexibility on the job.
