it was funny, but I find it weird that stewart doesn't mention the fact that you can't just TAKE a phone and sell it....because that's a crime?

As I understand it, it is okay to take and sell a lost item if you've made a good faith effort to return it first. In this case both parties did contact Apple and offer it back. Apple argues that they needed to try contracting the bar and the original owner for it to be good faith. And there's nothing wrong with divulging trade secrets if you've done nothing inappropriate in obtaining them.

I would have found it funny if Gizmodo had orchestrated a conversation along the lines of, "well, we have no idea if this is an Apple 4g iPhone. We don't have another one or any information to compare it with. As far as we know, this is the product of a mad cell phone scientist who wants to work for Steve Jobs..."
