Anax, once Davis was convicted, appeals courts would only consider either procedural faults in the original trial, or a new proof of innocence. The execution went forward because Davis, unlike hundreds of rape-murder convicts later exonerated, could not prove it wasn't his DNA. There was no physical evidence to refute.

As far as I'm concerned, pretty much all eyewitness identifications should be as inadmissible as hearsay. Alternatively, a third party with no interest in getting convictions should conduct all suspect lineups. Humans are bad at recording identity.
