Among other things, this is just terrible legal advice from a terrible lawyer. He seems to be suggesting that they're not risking jail themselves. Oops!
This isn't a joke, it's something that I read in a book.
Trump's reputation for not paying his lawyers is why he can't get better lawyers.

Rudy has decided to argue that Biden won the election by fraud as part of Trump's impeachment. I'm no lawyer, but this has got to be an incredibly bad idea, and Trump is probably behind it. I'll be tuning in for that train wreck.
