This doesn't put prop 8 into perspective. If the law were to say "Left handed people cannot marry," then the law discriminates against the left handed. The current law states none may marry a member of their same sex. All the left can come up with is a bunch of boring nonsequiturs.
I don't see why you guys keep following this Prop 8 angst? Unless of course you were planning on gay marriages for yourselves. Don't worry, I'm sure the tux shop will give your deposit back.

It's true, there's no discrimination in saying "You can't marry someone of the same sex" because it applies to everyone equally. Just like saying "You can't marry someone of another race" isn't discrimination.
Unless you've read Virginia v. Loving. Then that view becomes kinda problematic.
But I'm sure you're right, future generations will be totally cool with impairing liberty of contract between consenting adults, just as history looks kindly on anti-miscegenation laws.
