As soon as it leaves a protective radius of Mario, it respawns at the top before hitting the death floor. It is impossible to kill the baby penguin, the baby penguin is immortal.

However, it is possible to break the level by getting the penguin stuck in the chimney, but its a very dumb luck thing.

I'm saying that the only way to kill Tuxie the Immortal is to cartridge tilt right when you get a perfect hang toss into chimney, wait for the glitch, and then unplug your N64.
