Everything that follows is Gaetz trying to "gotcha" the biden administration a few notches when the presidential branch has already begun the process to review its schedule I status.

Long answer: Descheduling of MJ is definitely gonna happen, and it'll OBVIOUSLY be legalized RIGHT before Biden's re-election vote comes up in order to maximize the bump effect it'd have across the country for his re-election odds.

The head of the DEA themselves can order rescheduling, they don't have to wait for anything. Pretending to not have an opinion on it either way imho is a cop-out to conceal the fact that the administration and all of congress is against this. It won't happen next year, this is a stall so that the answer to 'why is marijuana still schedule 1' will be 'oh we just have to follow this process' until the excuse can become 'now is not the time for this frivolity, we have the most important election ever coming up'.

I think it's bold to assume that the Democratic Party's electoral self-preservation instinct is stronger than their desire to continue the carceral state exactly as-is.
